Contest Rules

1. CONTEST PERIOD

“TGP 2024 SUMMER” Contest (the “Contest”) is run by Action Auger Canada Inc., operating as The Gentlemen Pros (the “Administrator”) and will take place in the province of Alberta from April 1, 2024 at 12:01 AM (MST) to June 30, 2024 at 11:59 PM (MST) (the “Contest Period”).

2. ELIGIBILITY

The Contest is open to all individuals who:
(a) Reside in the province of Alberta; and
(b) Have reached the age of majority in Alberta as of the date of entering the Contest.
Employees, agents, and other representatives of the Administrator, as well as any individual with whom said employees, agents, or other representatives reside, are not eligible to enter the Contest.
For the purposes of this Consent, whenever used in these Contest Rules, the term “Eligible Individual” shall mean an individual who is eligible under the criteria of this clause.

3. METHODS OF ENTRY

a. SIGN-UP ONLINE

An Eligible Individual may enter the Contest by completing an online contest entry form where the following information must be provided:
• Full legal name;
• A valid telephone number; and
• A valid email address.
Upon completion of the form, the Eligible Individual will obtain one (1) entry into the contest (a “Entry”). Eligible Individuals shall be permitted one (1) entry per day.

b. MAIL-IN

An Eligible Individual may enter the contest without providing their email address by mailing an original, handwritten letter of at least fifty (50) words in length, explaining their reason for entering the Contest with their full legal name, full mailing address, and a valid telephone number to:

To be eligible, mailed entries must be postmarked no later than the end of the Contest Period and received within three (3) business days from the end of the Contest Period. An Eligible Individual will obtain (1) Entry into the Contest for a mailed entry. There is a limit of one (1) mailed entry per envelope with sufficient postage.

4. PRIZE

There is one (1) prize, which shall consist of:
• One (1) air conditioning unit suitable to the property at which the air conditioning unit will be installed (the “AC Unit”); and
• Delivery and installation of the AC Unit within the Service Area of the Administrator.

For the purposes of these Contest Rules, the “Service Area” shall mean the municipalities of Calgary, Edmonton, and Red Deer, and properties within a fifty (50) kilometer radius of Calgary, Edmonton, or Red Deer.
The approximate retail value of the Prize is between $4,000 and $6,000. The final retail value of the prize will depend on specific details pertaining to the winning entrant, including the location of the property at which the AC Unit is to be installed, and the type of property which the air conditioning unit is to be installed.

5. DRAW

On July 5, 2024, at 11:00 AM (MST) in Calgary, Alberta at the office of the Administrator, one (1) entry will be randomly drawn from all the entries received during the Contest Period.

6. ODDS

The odds of winning depend on the number of entries received during the Contest Period.

7. AWARDING OF PRIZE

a. To be declared a winner, a selected entrant must, in addition to being an Eligible Individual and complying with all the Contest Rules:

i. Be reached by email by the Administrator or a representative thereof within three (3) business days following the selection of the Entry;
ii. Have correctly answered a mathematical skill-testing question received via email; and
iii. Sign and have witnessed the declaration and release documentation and return it to the Administrator within three (3) business of days of its delivery to the individual by the Administrator.

b. In the event that the selected winner utilized the mail-in method of entry as outlined in clause 3.b. above, the selected entrant must, in addition to being an Eligible Individual and complying with all the Contest Rules:

i. Be reached by phone by the Administrator or a representative thereof within three (3) business days following the selection of the Entry;
ii. Have correctly answered a mathematical skill-testing question received via mail; and
iii. Sign and have witnessed the declaration and release documentation and return it to the Administrator within three (3) business days of its receipt by the individual.

c. DISQUALIFICATION:

If any one of the conditions mentioned in these Contest Rules is not complied with, the selected entrant will be disqualified and shall not be entitled to receive the prize, and the Administrator shall select, at random, another Entry as a potential prize winner.

d. DELIVERY OF PRIZE:

Following the receipt of the selected entrant’s signed declaration and release documentation, the Administrator, or a representative thereof, will contact the selected entrant to facilitate the delivery and installation of the Prize during the months of July and August 2024. The Administrator reserves the right to select and provide an air conditioning unit which is adequate to the property of the selected winner, in their sole and unfettered discretion.

8. GENERAL TERMS AND CONDITIONS

a. ENTRY VERIFICATION:

The validity of any Entry is subject to verification by the Administrator. Any Entry that is ineligible, incomplete, fraudulent, or otherwise non-compliant with these Contest Rules, in the sole discretion of the Administrator, acting reasonably, will be disqualified. Any individual who enters, or attempts to enter, the Contest in a manner that is contrary to these Contest Rules or is otherwise disruptive to the proper operation of the Contest or by its nature would be unjust to other entrants or potential entrants, will be disqualified. All decisions made by the Administrator or its representatives, including those concerning eligibility or disqualification, shall be final and binding without right of appeal. All entries become the property of the Administrator, and none will be returned.

b. ACCEPTANCE OF PRIZE:

The Prize must be accepted as described in these Contest Rules and cannot be returned, transferred to another individual, substituted for another prize or exchanged in whole or in part for cash value, except as set out in clause 8.c. below.

c. SUBSTITUTION:

The Administrator reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute for the Prize, or part thereof, another prize of equivalent or greater value, including a cash reward.

d. CHANGES TO CONTEST RULES:

The Administrator reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including any computer virus, or unauthorized human intervention or any other cause that is beyond the control of the Administrator that could corrupt or affect the administration, security, impartiality, or normal course of the Contest.

e. RELEASE AND EXCLUSION OF LIABILITY

i. BY ENTRANTS: By entering or attempting to enter the Contest, each entrant agrees:
1. To release, discharge, and forever hold harmless the Administrator and all associated individuals and organizations from any and all claims, actions, damages, demands, contracts, and liabilities of whatever nature or kind arising out of or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest Rules, and acceptance and use of the Prize; and
2. If the entrant is selected as a potential winner, to sign the declaration and release documentation referred to in clause 7 above, prior to the receipt of the Prize. The Administrator shall not be responsible for lost, incomplete, late or misdirected entries, or any failure of the Contest website, if applicable, during the Contest Period, or any technical malfunction or other problems with internet or telephone lines or networks, servers, access providers, computer equipment or software, or technical difficulties on the Contest website, or any combination of the foregoing, and will not be liable for any resulting death, injury, or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Administrator reserves the right to seek remedies and damages to the fullest extent permitted by law.

f. NAME AND IMAGE OF WINNER:

By entering the Contest, the winner of the Prize authorizes the Administrator to broadcast, publish, and otherwise use their name, image, statements regarding the Contest or the Prize, and voice for publicity purposes, without any form of remuneration.

g. EMAIL CONSENT:

By providing a valid email address, each entrant agrees that the Administrator can send the entrant communications via email which may include information which may be of interest to the entrant regarding the Administrator’s products and services. If at any time the entrant wishes to stop getting such communications, the entrant can contact the Administrator via email.

h. PERSONAL INFORMATION:

The personal information gathered about the entrants in connection with the Contest will be used for the purpose of administration of the Contest and communication of further promotional materials as outlined in these Contest Rules.

i. DISCLAIMER:

The Contest is in no way sponsored, endorsed, or administered by or associated with any other entity. The entrant provides personal information to the Administrator and not to any other person or entity.
